This Privacy Policy is addressed  to Users of the Site by Proman Canada  Inc. , as well as any natural or legal person entrusting  personal information  to Proman Canada  Inc.  and aims to inform them about the manner in which their  personal information  may be collected and processed.

Respect for privacy and personal data is a priority for PROMAN.

In any event, we undertake to respect the following two (2) essential principles:

Article 1. Definitions

“Candidate”  : means a natural person looking for a job, who has never worked at PROMAN, or who works for Proman as part of a temporary job, sending their CV to PROMAN or applying for the Job Offers referenced on the Site. 

“Unsolicited application”:  means the fact for a Candidate to submit to PROMAN an application unrelated to any Job Offer. 

“Order”  : means the request to search for a Candidate made by a Company to PROMAN. 

“Data”  : means all data recorded, downloaded or entered by the User or by PROMAN teams on behalf of the User when using the Site. If this Data is personal, it is referred to as “Personal Information”. 

“Employment”  : refers indifferently to permanent or temporary employment 

“Company”  : means any legal entity that is a client or prospect of PROMAN looking for Candidates. 

“Job Offer”:  means the Job proposal formulated by PROMAN to meet the needs of a Client, for an Internal Job or to feed its candidate database. 

“Parties”  : means together PROMAN, the Candidates and the Companies. 

“Services”  : generally refers to the Services offered by PROMAN to Candidates and Companies via the Site. 

“Site”  : means the Internet Site accessible at the address https://proman-emploi.caThe Site brings together all the web pages, services and functionalities offered to Users. 

“Terminal”  : means a connected computer device such as a smartphone or tablet, with an internet connection and which is compatible with the use of the Site. 

“User”  : means any natural or legal person who visits the Site, whether the connection is made directly or via a partner portal. 

Article 2. Identity and contact details of the data controller

The controller of your data transmitted via our website is PROMAN GESTION, a simplified joint stock company registered in the MANOSQUE Trade and Companies Register under number 490 673 423, whose head office is located at Zone Industrielle Saint Maurice, 04100 Manosque, FRANCE. 

PROMAN will have the status of data controller for processing relating to: 

  • Management of Business Orders; 
  • Management of requests to exercise rights; 
  • Management of the proper functioning of the Site; 
  • Sending email marketing and other alerts. 

PROMAN will have the status of co-controller with different actors for the following processing operations: 

  • Management of Candidate applications: joint responsibility with Companies.

Legal reminder:

The  data controller  is, within the meaning of the French Data Protection Act and the GDPR, the person who determines the means and purposes of the processing. 

The  processor  is a person processing personal data on behalf of the controller, acting under the authority of the controller and on the latter’s instructions. 

That being said, this confidentiality policy concerns the data processing carried out by PROMAN in its capacity as data controller.

The amendments resulting from Law 25 promote transparency for businesses and better control over the personal information of the individuals concerned. These measures ensure better protection of the privacy of the latter, while taking into account today’s technological reality. 

In accordance with Law 25, PROMAN undertakes to notify the persons concerned if a security incident were to compromise their personal data. 

Article 5. Collection & origin of data

As part of the provision of the Services, PROMAN collects and processes personal data relating to Users. 

This data comes directly from Users. 

In all cases, you are informed of the purposes for which your data is collected by us via the various online data collection forms, emails or text messages that may be sent to you.

As part of compliance with the principles of data protection by design and data protection by default, PROMAN ensures that the necessary consents have been collected when Users register.

Article 8. Data processed

The mandatory or optional nature of the personal data collected and the possible consequences of a failure to respond are indicated when they are collected on the associated forms.

In any event, PROMAN undertakes to process all data collected in accordance with the GDPR, the French Data Protection Act and the Personal Information Protection Act as amended by Law 25 of the province of Quebec. 

For the management of Candidates’ applications  concerning the processing carried out via Proman Emploi

  • Data relating to the identity of Candidates: surname, first name(s), address, telephone number, email address; 
  • Candidates’ CVs; 

For the management of Candidates’ applications  concerning processing carried out via the internal Proman Canada Inc. application processing software

  • Data relating to the identity of candidates: surname, first name(s), address, telephone number, email address; dates of birth, 
  • Data relating to the identity of temporary employees: Social insurance numbers, bank details 
  • Employee CVs; 
  • Identity documents; 

For the management of Business Orders:

  • Data relating to the identity of the Company representative: surname, first name(s), telephone number, email address 

Sending marketing via email or text message: 

  • Data necessary for sending job offers to Candidates as part of recruitment campaigns or any other information that PROMAN deems necessary. 

Management of requests to exercise rights: 

  • Name, first name, telephone number, email address; 
  • If applicable, copy of identity document. 

Management of the proper functioning of the Site: 

  • Data collected via cookies and other tracers present on our Site; 

Article 9. Recipients of your data

Within the limits of their respective attributions and for the purposes recalled in article 6, the main persons who will be likely to have access to your data are the following: 

  • Authorized personnel from the various PROMAN departments (administrative, accounting, marketing, sales, logistics and IT departments, etc.); 
  • Businesses; 
  • The companies responsible for managing the Site; 
  • Service providers who provide services on our behalf, for example hosting services, web design services such as Market Academy, or our management software published by People 2.0; 
  • Where applicable, the authorized personnel of our subcontractors; 
  • Where applicable, the relevant courts, mediators, accountants, auditors, lawyers, bailiffs, debt collection companies, police or gendarmerie authorities in the event of theft or judicial requisition, assistance; 
  • Third parties that may place cookies on your devices (computers, tablets, mobile phones, etc.) when you consent to them (for more details, see our Cookie Management Charter). 

Your personal data is not communicated, exchanged, sold or rented without your express prior consent in accordance with the applicable legal and regulatory provisions. 

Article 10. Transfer of data outside the European Union  and the province of Quebec

The PROMAN Canada Inc. website is hosted in France. 

All data collected via the Proman Canada Inc website via the application form is immediately transmitted to Canada and stored in application management software hosted in Canada, particularly in Ontario. 

Proman’s IT services that may occasionally intervene are located in France or the United States. 

Article 11. Data retention period

We keep your data only for the time necessary for the purposes pursued, as described in article 7, and summarized below.

Definition of recurring and one-off employment areas

Recurring jobs refer to areas and geographic locations where demand for personnel remains stable and frequent. In this context, if a candidate is not selected for a particular position, we retain their data in order to maintain active contact. This data retention allows us to present them with other similar job opportunities in similar geographic areas. This approach is made possible by the constancy of demand in these sectors, which increases the chances of a match between the needs of companies and the skills of the candidate.

Conversely, occasional employment fields typically involve one-off, isolated recruitments. In such situations, it is unlikely that a candidate who is unsuccessful in one position will be approached for similar jobs in the future, due to the irregular and less predictable nature of demand for these positions.

PROMAN is committed to maintaining an up-to-date list of domains and geographic areas classified as recurring or one-off jobs. This information is available upon request from our Privacy Officer.

For the management of candidates’ personal information:

The data collected for the creation of an application file are kept for the entire duration of the contractual relationship with PROMAN. In the event of hiring, in accordance with current tax legislation, this data will be kept for a period of seven (7) years.

If the application process does not result in a job, the data will be anonymized according to the following deadlines:

  • If the candidate has not completed the application process, the data will be kept for a period of three (3) months.
  • For candidates who have completed the application process for a recurring job, the data will be kept for three (3) years.
  • For candidates who have completed the application process for a one-off job, the data will be kept for a period of one (1) year.

For the management of Business Orders:

The data collected for processing relating to the management of Company Orders is kept for the entire duration of the contractual relationship with PROMAN.

They are subsequently stored for seven (7) years for evidentiary purposes in accordance with the legal and regulatory obligations to which PROMAN is subject.

Sending email marketing and other alerts:

For email marketing and other alerts, the same personal information retention periods as mentioned above apply.

Management of requests to exercise rights: 

Data relating to the management of legal requests are kept for the entire duration necessary to process the request. They are then archived for the applicable criminal limitation period in intermediate archiving. 

Management of the proper functioning of the Site: 

Cookies and other commercial trackers may be placed on the User’s terminal for a maximum period of thirteen (13) months. Beyond this period, the raw traffic data associated with a User is either deleted or anonymized. 

Information collected through cookies and trackers is stored for a period of twenty-five (25) months. Beyond this period, this data is deleted or anonymized. 

Article 12. Your rights

You have the following rights regarding your personal information. 

Right to be informed: You have the right to receive clear, transparent and easy-to-understand information about how we use your personal information and your rights. 

Right of access: You have the right to access the personal information we hold about you – because we want you to know what personal information we hold about you and to enable you to check whether we are processing your personal information in accordance with applicable data protection laws and regulations. 

Right to rectification: If your personal information is inaccurate or incomplete, you have the right to request rectification.

Article 13. Connection data and cookies

For the proper functioning of the Site and Services, we use connection data (date, time, Internet address, visitor’s computer protocol, page consulted) and cookies (small files saved on your computer) allowing us to identify you, to memorize your consultations, and to benefit from audience measurements and statistics, in particular relating to the pages consulted.

The PROMAN Site and Services are not intended for minors. PROMAN does not knowingly collect personal data from minors under the age of 14.

Article 15. Security

We implement all necessary technical and organizational measures to ensure the security of our processing of personal data and the confidentiality of the data we collect and thus  prevent unauthorized access, loss, alteration or destruction of data.  We have taken steps to ensure that the only personnel authorized to access your personal information are those whose functions reasonably require them to have access to it. Despite the measures described above, no method of transmission or storage of information is 100% secure or error-free. As such, we unfortunately cannot guarantee absolute security. If you have reason to believe  that your interaction with us is no longer secure (for example, if you feel that the security of the information you have provided to us has been compromised), please contact us immediately using the contact details  in Section 4 .

 Data protection legislation is not static. PROMAN is committed to monitoring the evolution of data protection laws, regulations and best practices. Accordingly, this policy will be reviewed regularly to reflect relevant changes and developments  .
